Sustainability Victoria has updated the FirstRate5 End User Terms of Service (End User Terms of Service) and FirstRate5 Software Licence Agreement (Software Licence Agreement), which apply to the FirstRate5 website and software.

The updated End User Terms of Service and the Software Licence Agreement apply to: 

• New users of the FirstRate5 website and software, effective 9 November 2023; and
• Existing users of the FirstRate5 website and software, effective 16 November 2023.

Below is a list of the changes that have been made to the existing End User Terms of Service:

• Removed version reference;
• Changes to clause 2(c);
• Changes to clause 4(b);
• Changes to clauses 8(b),8(b)(E), 8(g) and 8(h) and 8(l)(iii);
• Changes to clauses 9(a) and 9(b);
• Changes to clauses 10(b), 10(c), 10(d) (including the sub-paragraphs) and 10(e);
• Changes to clauses 12(e)(i) and 12(e)(ii);
• Removal of clause 12(ha);
• Removal of clause 12(n).
• We have made the clause headings bold

Below is a list of the changes that have been made to the existing Software Licence Agreement:

• Changes to the introductory paragraph;
• Changes to clause 1;
• Changes to clause 7(a)(ii);
• Changes to clauses 8(a)(x) to (xxviii);
• Changes to clause 10(a), 10(b), 10(g), 10(h), 10(l)(iii), 10(m)(ii);
• Changes to clauses 12(a) and 12(b);
• Changes to clauses 15(b) (new clause inserted at 15(b), former clause 15(b) is now 15(c)), 15(c) (including sub-paragraphs) amended and split into 2 new clauses 15(d), and 15(e);
• Changes to clause 16(a); and 16(b);
• Removal of clause 18(d).

If you do not agree with the updated Software Licence Agreement and End User Terms of Service, you can choose to discontinue using the FirstRate5 software and website and advise us that you intend to terminate your licence to the FirstRate5 software and/or FirstRate5 website Terms of Service.
